What is and what is the purpose of whistleblower protection?

In 2019, Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of individuals who report breaches of Union law was adopted at European Union level. According to this legislation, effective and comprehensive protection of whistleblowers, i.e. individuals who report work-related wrongdoing, is an essential element of the fight against corruption and part of a functioning rule of law. Whistleblowers not only save public and private funds, but can also contribute to the protection of public health, save lives, help prevent environmental disasters, etc. Individual Member States have adopted their transposition laws in connection with the Directive, in the Czech Republic it is Act No. 171/2023 Coll., on the Protection of Whistleblowers.

Individual protection and personal data protection

In the matter of personal data protection, as well as in the issue of the protection of the whistleblower and the reporting person, the procedure is in accordance with the applicable legal regulations and internal regulations. In the case of whistleblowing, the whistleblower has the right to confidentiality and other protection. The whistleblower must be identified.

How the notification will be handled

Depending on the content of the report, the Authorised Person will take appropriate action and inform the whistleblower of the results of each report, where possible. Feedback on the results of the report is provided to the whistleblower within a period of time reasonable for the evaluation of its content and the taking of appropriate action.
